Frequently Asked Questions: Car and Truck Wrecks

Injury & Malpractice Attorney Serving Clients Near Dallas, Ft. Worth, Plano, Arlington, Irving, North Texas & Arkansas

Over the decades that we have been handling car and truck wrecks, our attorneys and staff have come to know that people who have been involved in car or truck wrecks have some of the same concerns.  Here are some of the most common questions and their answers:

Do I Need an Attorney?

The answer to this question is almost certainly "yes" unless your car accident was very minor and there are no injuries.  Insurance companies are generally pretty good about repairing damage to vehicles and generally really, really bad about paying reasonable compensation for damage and injuries to people hurt in a car or truck accident.  If a car wreck insurance company does make an offer for your injuries, that offer is almost always just a fraction of what a competent car or truck accident attorney would obtain for you.

One of the things that insurance adjusters are trained to do in car accident cases is to tell people that "they don't need an attorney" or that "the attorney will take all the money that we are offerening and you will end up getting less".  Car accident adjusters are trained to say this because insurance companies know that if you hire an attorney the insurance company will pay much more than if you don't have an attorney.  In over 25 years of handling car and truck accident cases, we have NEVER had a case where our clients got less in their pocket than they would have if they had taken the insurance company's offer.  Not once.

How Much Will This Cost?

Nothing.  If we take your case we get paid only if we get a recovery for you, and then we are paid only a percentage of the money we get for you.  You never have to pay anything out of your pocket.

How Much Time Do I Have to Make My Car Accident Claim?

Probably not as much as you might think.  You may have as little as six months, and you might have as long as two years, depending on the facts of your case and who you are suing.  But there is no reason to wait, and many reasons to act right away.  If you delay, evidence may be lost forever, witnesses may forget or move, and it may become impossible to win your case.  Call a car wreck attorney right away.  If it is too early to file suit, we'll tell you that.  Otherwise, the sooner we get started the sooner we can get you the recovery you deserve.

What Is My Case Worth?

Nobody can answer that question without knowing all the facts of your case and details like what court you will have to file your case in, how much insurance the other driver has, and what medical expenses you are likely to have in the future because of your car accident.  Two things are certain, though:  your case is worth much more when it is handled by an experienced car and truck accident lawyer than when it is handled by one of those advertising lawyers or by a rookie lawyer who doesn't know what he's doing.  And the more experienced your lawyer, the more likely it is that the insurance company on the other side will pay a fair settlement instead of making you go through a trial.

How Long Will This Take?

Your case could take anywhere from a couple of weeks to a couple of years to resolve, depending on the facts of the case, how vigorously it is defended by the other driver's insurance company, and whether you have to go to trial.  The more experienced your car or truck accident attorney is, the quicker and better your settlement will be and the less chance there is that you will have to go to trial.  Well over 95% of the car accident cases we handle settle without a trial.  Most of our cases are resolved within six months.

What About Getting Treatment For My Injuries?
