How much time do I have to sue?
Not much.
In injury cases the general rule in Texas is that you have two years in which to file suit from the date of the car accident which caused your injury. In certain types of injury cases you may have to give a formal notice of claim within six months of the car accident, or it is too late.
In most breach of contract cases, you have either two years or four years in which to sue. But there are many, many exceptions to these general rules. To take just a few examples: medical malpractice cases, fraud cases, and cases based on violations of various statutes all have different limitations periods-and if you wait even a day too long, you can never sue no matter how bad you were hurt. These rules are so confusing that even many lawyers get them wrong: you must not guess how long you have to sue-- and you must not assume that you have two years to sue just because that is the general rule.
